Motor Vehicle Damage Guarantee Fund
Imagine this: you are traveling in your car when you are suddenly hit by a car. When you get out to talk to the perpetrator, it turns out that he or she is not insured. Or you park your car to run an errand, but when you come back there is a big dent in your car. The culprit is nowhere to be found. Both situations in which you sustain car damage but have nowhere to recover the damages. In these cases you can appeal to the Motor Traffic Guarantee Fund. Is car damage compensated by the Guarantee Fund?
Yes, in some cases car damage is compensated by the Waarborgfonds. However, there are a number of conditions attached to this. The Guarantee Fund only compensates damage if:
- It is not known who caused the damage
- The motor vehicle is not insured
- The motor vehicle is stolen and the driver knows about the theft
- The insurance company of the motor vehicle causing the damage is bankrupt
- The owner of the vehicle has an exemption from the obligation to take out insurance due to a state of mind
Car damage is only compensated if it is caused by another motor vehicle. If the damage is caused by a collision with a cyclist or other object, such as a shopping trolley, it will not be compensated. Damage caused by vandalism or destruction will also not be compensated.
Witness statement
If there is no known perpetrator in car damage, you must be able to prove proof of the collision yourself. The Guarantee Fund also only compensates damage if you make an effort to find out who the perpetrator is. For example, with a police report, a neighborhood investigation or an advertisement. Also try to find witness statements. Of course, it is difficult to find witnesses who actually saw the collision. This is why the Guarantee Fund also works with location witnesses. A location witness can confirm that the parked car:
- Parked without damage
- No more driving in the meantime
- Found parked with car damage
The Guarantee Fund has drawn up a witness statement form, which you can have filled in by any witnesses.

If you want to claim damage from the Guarantee Fund, you have to fill in several forms. Of course you must fill in a claim form, on which you indicate in detail what damage has been suffered. Is car damage caused by vandalism compensated by the Guarantee Fund?
You can only appeal to the Guarantee Fund if the damage is caused by a motor vehicle. Damage caused in another way, for example car damage caused by vandalism , is therefore not compensated by the Guarantee Fund. Damage caused by a bicycle will also not be compensated. In that case, there is no point in submitting a claim to the Guarantee Fund.
Own risk Guarantee Fund for damage to cars
The Guarantee Fund compensates both property damage and personal injury, as long as it was caused by a motor vehicle. Was the damage caused by an unknown motor vehicle? Then the Guarantee Fund applies a deductible of €250. There is no deductible if the damage is caused by an uninsured motor vehicle, by a stolen motor vehicle, or by a motor vehicle owned by a person in need of protection.
